The Politicization of Our Justice System
If you are of Hispanic descent, you should be alarmed by the what is playing out in the American justice system today. Today’s politicization of our justice system closely resembles that of banana republics in Latin America.
The weaponization of the justice system is the “norm” in third-world countries, where socialists prosecute the opposition, former presidents, leaders, their staff, sympathizers, and anyone who dares to stand against the government. But not in America. At least that’s how it’s supposed to work.
Tyrannical regimes in Latin America arbitrarily arrest and prosecute government critics, political opponents, journalists, lawyers, leaders of the community, etc. Their charges are always the same: a threat to democracy, treason, conspiracy to undermine national integrity… Freedom of expression is restricted and a free press often does not exist since in many cases, the press works for and with the government. Internet speech is threatened and criminalized as “false, distorted, or hateful speech” and prosecuted under their cybercrime laws. All of these actions serve to spread fear and control the citizens. The political narrative is orchestrated by the state and their allies, and the people are subjected to a singular message. All government opponents are persecuted, prosecuted, and justice is never applied evenly. Government leaders are not held accountable for their corruption and enjoy wielding their power on those who oppose them.
On April 4, 2023, former President Donald J. Trump was indicted in a New York City courtroom for allegedly “falsifying New York business records in order to conceal damaging information before the 2016 presidential election.”
Regardless of how one feels about former President Trump, the indictment by Manhattan District Attorney Alvin Bragg is unprecedented and targeted. A former president has never been charged with a crime, and if it is warranted, the law must be applied evenly and objectively; we are thereby morally obligated to consider the serious crimes committed by other higher-ups that would warrant similar treatment.
Consider that Hillary Clinton, former Secretary of State under President Barack Obama, started using personal servers in 2009 and communicated government business with foreign governments for years before it was discovered by the House committee conducting investigations on the American Consulate attack in Benghazi. By using a private server, Clinton was able to control the discoverability of emails that are subject to Freedom of Information Act (FOIA) release. Federal Bureau of Investigation (FBI) director at the time, James Comey, acknowledged that it was ““possible”” that enemy foreign governments had accessed Clinton’s personal email account.” In spite of this, Comey recommended that “no charges” be filed by the Department of Justice in spite of Clinton jeopardizing national security. “We cannot find a case where we would bring a prosecution based on these facts” said Comey. Over 30k classified and personal emails were reported by Clinton’s team before proceeding to wipe the server clean and destroy anything that was left. No raid was ever conducted on Clinton’s Chappaqua home in New York. No charges were brought against a former secretary of state.
Consider that President Joe Biden has been found to be in possession of hundreds of classified documents dating as far back as his time as senator in the United States Senate and during his time as vice-president under President Barack Obama. Classified documents have been found in Biden’s storage facilities, his Delaware home, and at the Penn Biden Center. No raid was conducted on Biden’s properties. No charges have been brought against a current sitting president.
Consider that the DOJ issued a warrant to search Trump’s Mar-a-Lago home in August 2022 in search of classified documents that he might have mishandled and taken after his time in the White House. Around thirty armed federal agents participated in the search of his home. Investigators for the justice department are eyeing possible charges against Trump. Trump is not only a former president but a candidate for the 2024 presidential election; he is a political opponent to the existing president and the Democratic party. Charges are pending for this former president of the United States.
The three potential crimes listed in the warrant used in president Trump’s search are certainly applicable to the Clinton and Biden cases: misuse of national defense information; obstruction of justice by destroying, altering, or falsifying records in connection with a federal investigation; and concealing, removing, or destroying protected federal documents.
Our justice system must be applied objectively and evenly, not subjectively and disparately. Where is Lady Justice’s equality under the law?
The politicization of our justice system by the Biden administration’s Department of Justice and the Federal Bureau of Investigation is cause for alarm. The weaponization of justice by Biden’s federal agencies are an attempt to thwart a political opponent’s run for presidential office in 2024. Irrespective of one’s opinion of former President Trump, when the law is applied unfairly, favoring one political actor and one political party over another, it severely undermines the sanctity of our justice system and stability of our nation.
Nancy Pelosi, California Democrat and former speaker of the House of Representatives recently tweeted: “No one is above the law and everyone has the right to a trial to prove innocence.” She is gravely mistaken. Everyone is innocent until proven guilty in the eyes of Lady Justice. Shame on Pelosi for wielding her status in office to push such misrepresentation of our justice system.
President Trump’s legal troubles are many, and as a law-abiding nation we must allow the justice system to run its course. We must pay close attention to what we’re witnessing and be ready to hold these officials accountable at the next election. Elections are our only recourse to getting our point across and bringing about change in our nation. If we are not a nation of laws, we are no nation.
In a partisan and unprecedented move by federal agencies under the Biden administration, the real crime committed here is being a conservative who is highly disliked and threatened by the opposing party. Banana republics are notorious for governments that persecute and remove opposition at will and without consequences. And as previously noted, opponents can be leaders or average citizens. They can come after us just as easily as they can come after powerful politicians they dislike.
“Show me the man and I’ll find you the crime.” Lavrentiy Beria, secret service chief under Stalin who was responsible for the massacre of over 22k people and Polish soldiers, spoke these words which rang true then and still today in many parts of the world. In America, we are innocent until proven guilty and not according to our dislike of government. Hispanics must not forget the experiences of where we come from and with our voting power, we must do our best to ensure that America remains fair and free for all.
